What is Payoff / Sub Escrow??

Sub-escrow (loan payoff) is an extremely important service provided by title companies to facilitate the handling of money in the closing of a real estate transaction. The performance of the payoff function, exclusive of escrow services, is unique to Southern California. This is because the majority of our customers are independent escrow companies, and the majority of our title orders require payoff service.

The sub-escrow department does not draw escrow instructions or documents (i.e. Grant Deeds, Trust Deeds, etc.) They do not order demands for payoff, but do make the payoffs at the close of escrow.

A subescrow fee is a fee charged by the Title Company for the following services:

  • Coordinating with the escrow company or lender for recording
  • Verifying and updating pay-off demand figures with the lender
  • Verifying payment of property taxes
  • Calculating the pay-offs on the day of closing
  • Disbursing all pay-offs and net proceeds per instructions
  • Upon confirmation of recording, notifying the escrow company
  • Process refunds

Sub-escrow has a language of its own—note the following brief definitions of commonly used terms, intended to answer some of the questions you may have regarding the subescrow (payoff) function.

Payoff – The receipt of funds from the buyer and the payment of the obligations of the seller in conjunction with a real estate transaction. The payoff function is performed by the title company.

Payoff Fees – Title fees for handling a payoff vary slightly from county to county. The fee is strictly a processing charge and does not cover special handling charges or potential shortages.

Prefigures – Estimated payoff figures are calculated and given prior to closing upon request. These figures are only valid through the date given and are based on the information provided at the time.

Good Funds – Title must be in receipt of “Good Funds” prior to disbursing on a pay-off. Types of “Good Funds” include:

1. Funds wired into Title sub-escrow account

2. A cashier’s, teller’s or certified check will provide next day availability after deposit, to comply with AB512.

3. All other local checks will provide availability of funds two (2) days after deposit.

4. Out of area checks will provide availability of funds five (5) days after deposit.

Taxes – Outstanding property taxes can be paid out of the payoff process.

Demands – Demands must include specific payoff information concerning the particular property and must be signed. It is the responsibility of the escrow to order and provide all necessary demands including any updates or changes on a timely basis.

Refunds – Any overpayments of demands will be refunded to the escrow upon receipt from the lender. Refunds typically take two to six weeks to process.

Shortages – Title will be refunded to the escrow if there is a shortage of the necessary funds to cover the outstanding obligations. The shortages must be received prior to payoff.

Disbursement Checks – Checks are delivered locally to lending institutions by a contracted messenger service. Checks to individuals and to out of area lenders are typically sent via an overnight delivery company.

Wire Transfers – Funds can be wired in to or out of the Title account.

Out of County Transactions – Title offices can receive and disburse payoff funds through any of our Title offices.

Drafts – Title drafts are used to disburse the payoff proceeds to the escrow companies.

¿Qué es Payoff / Sub Escrow?

Sub-escrow (pago de préstamo) es un servicio extremadamente importante proporcionado por las compañías de títulos para facilitar el manejo de dinero en el cierre de una transacción de bienes raíces. El desempeño de la función de pago, excluyendo los servicios de custodia, es exclusivo del sur de California. Una tarifa de subescrow es un cargo que cobra la Compañía de Títulos por los siguientes servicios:

  • El Sub-Escrow tiene un lenguaje propio: anote las siguientes breves definiciones de términos comúnmente utilizados, que tienen por objeto responder a algunas de las preguntas que pueda tener con respecto a la función subescrow (payoff).

Pago – La recepción de los fondos del comprador y el pago de las obligaciones del vendedor en conjunción con una transacción de bienes raíces. La función de pago se realiza por la compañía de títulos.

Cuotas de pago – Las tasas de título para manejar un pago varían ligeramente de un condado a otro. La tarifa es estrictamente un cargo de procesamiento y no cubre cargos especiales de manejo o escasez potencial.

Prefiguras – Las cifras estimadas de pago se calculan y se dan antes del cierre a solicitud. Estas cifras sólo son válidas hasta la fecha indicada y se basan en la información proporcionada en ese momento.

Buenos fondos – El título debe estar en el recibo de “buenos fondos” antes de desembolsar en un pay-off. Los tipos de “Bonos Fondos” incluyen:

1. Fondos conectados a la cuenta de subcritería de título

2. Un cajero, cajero o cheque certificado proporcionará la disponibilidad del día siguiente después del depósito, para cumplir con AB512.

3. Todos los demás cheques locales proporcionarán disponibilidad de fondos dos (2) días después del depósito.

4. Los cheques fuera de área proveerán la disponibilidad de fondos cinco (5) días después del depósito.

Impuestos – Los impuestos sobre la propiedad pendientes pueden ser pagados del proceso de pago.

Demandas – Las demandas deben incluir información específica sobre la recompensa relacionada con la propiedad en particular y deben ser firmadas. Transferencias electrónicas – Los fondos pueden conectarse a la cuenta de título o salir de ella.
